Mr Tim Mirfin (Objects)

Comment submitted date: Wed 15 Jun 2016

We are the nearest neighbour to this site and object to the extension of the business hours.

We currently hear a good degree of noise from the site and smell anything that is being burnt there. While there is hedging, it is mainly deciduous (and full of dead elm on our side) so fails shields much noise in autumn/winter.

The applicant's agent also has made a significant error of fact. The nearest part stable complex is not "around 130m to the nearest residential curtilage boundary" i.e. our garden, but 30m away. This is an exaggeration of over 400%. Perhaps that explains why we hear and smell more than the applicant suggests. In addition, traffic coming and going out of current business hours would be 3m away.

We take the point that the hours restriction could be interpreted, from a certain point of view, as not allowing the welfare of the livery horses to be looked after, as the council officer has acknowledged though he makes clear this was not the intention. Since this is a drafting error, we would like the planning officer to redraft the condition to keep the original intention intact but allowing for equine welfare (there is legal provision to do this).
