I am firmly of the view that none of the following satisfy the requirements for permitted development from Class B8 to residential use.

19/0633/PDP - feed store
19/0635/PDP - middle pigsty
19/0634/PDP - east pigsty

The main use of the overall site is a domestic dwelling; there are no consents for B8 use, certificates of lawful development, any evidence of business rates paid, or any other independent objective evidence to suggest that they qualify as B8 use.

I do not believe that any of the buildings qualify as B8 use because they are used in conjunction with, and ancillary to, the main domestic use and they are not therefore eligible for development under Class Q. Also, the materials stored are largely domestic in nature.

I also note that our Local Plan imposes strict controls on development within the open countryside and EDDC should ensure that these principles are strictly upheld - unless applicants can genuinely meet the requirements of GDPO - this one does not.

This application was considered at the West Hill Parish Council meeting on 2nd April. The Parish Council voted unanimously not to support the application The Parish Council voted unanimously not to support the application. Councillors noted that the building is used for domestic storage, as stated in this application and in the Planning Officer's Report for previous applications for this site, not commercial storage or a business use. Therefore, the building does not come under the Class B8 use and therefore does not comply with Class P of the GPDO 2015 regulations. For this reason, Councillors thought that the basis for the application was incorrect.
They also noted that no mechanism has been submitted to secure a contribution towards measures to mitigate the impacts of recreational use of the ecologically sensitive habitats of the European designated East Devon Pebblebed Heaths Special Area of Conservation and Special Protection Area by the occupants of the development.
